Introduction
Validity of status refers to the length of time a foreigner can legally stay in Canada. When the validity period expires, the status ends. The validity period of the identity mainly depends on the immigration documents that you hold, such as study permit, work permit, and super visa. If the expiration date is less than 90 days, the application for restoration of status (Restoration of Temporary Resident Status) can be submitted, but the applicant cannot work or study while waiting for the restoration of status.
How 90 Days Count
When does the 90 days start to count? There are two cases as follows:
· If the renewal application is not submitted and the applicant’s visa has expired, then 90 days will be counted from the day when the visa expires;
· If the applicant has submitted an application for renewal before the status expires, but the application is rejected, the 90 days will be counted from the day the letter of refusal is received.
Overall, expired status is a very troublesome thing, ranging from temporary suspension of school and work to pay more government fees. Our company hopes that you will always pay attention to your visa, so as to avoid over-signing or timely renewal.
Submission
1.The identity expiration date has not exceeded 90 days.
Within 90 days of the expiration of the status, you can submit an application for Status Restoration in the country without leaving Canada. According to the provisions of immigration law, during the period of the application for restoration of status, it is not allowed to study and work. Because during this time, the status has expired, which means that you no longer have the corresponding study permit/work permit status. Engaging in study or work is a violation of immigration law, and if found by the immigration bureau, there will be very unfavorable consequences.
While the application is being processed, the applicant cannot leave Canada. If you leave Canada, the immigration office finds out and will refuse the visa. In other words, once the status expires, nothing can be done, and only after the application is approved and a new visa is obtained, can you continue to study or work. However, not all of the expired status can be successfully applied for and need reasonable reasons and explanations.
2.The identity has passed more than 90 days.
If the identity expires for more than 90 days, there is generally no way to restore the identity. Applicants are usually advised to leave Canada as soon as possible consciously and reapply abroad.
Requirements
To submit an application for restoration of identity, the following application materials are generally required:
- IMM5708、IMM5709 or IMM5710
- Passport
- Current immigration document
- Digital Photo
- Proof of Means of Support
- Study and work permits accompanying family members, and proof of kinship; (if applicable)
- Explanation letter for overstaying. (if applicable)
